Holidays Act Remediation



Like many New Zealand employers, Genesis has identified issues that mean some of our employees have had their leave payments calculated incorrectly due to challenges with the interpretation and application of the Holidays Act 2003.

We’ve undertaken a thorough investigation of these issues using a third-party independent specialist, Ernst and Young, and our methods and calculations have been reviewed by the Ministry of Business, Innovation and Employment (MBIE) Labour Inspectorate. These calculations have been completed up to 31 July 2018 and we’ve identified which employees have been underpaid (we aren’t asking for over payments to be repaid).

If you worked for Genesis between 1 April 2012 and 31 July 2018 you may be eligible for a remediation payment

We are proactively contacting some former employees, however if you haven’t heard from us and worked for Genesis during this time, please complete the registration form below so we can check if you’re due a payment.


Our first remediation payment(s) will cover underpayments for the period from 1 April 2012 to 31 July 2018. We plan to complete another remediation calculation to cover the period from 1 August 2018 in due course to cover any underpayments from that date.

How we'll look after your information

We’ll hold your data until all remediation payments have been completed. If you’re not eligible for a payment, we’ll delete your details. If we’ve made a payment to you, we’ll hold your information on file for 6 years from the date of payment, at which point it will be deleted.

Supporting information checklist
There are a few documents that are needed to progress your registration. More details are provided in the registration form.

  • Bank account details and proof of your account
  • IRD number and Tax Code
  • Digital copy of a completed IR330 form. This is the form used to advise us of your tax code
  • Digital copy of a completed KS2 form. This is the form used to advise us of your KiwiSaver contribution rate
  • Photos of accepted ID (driver licence, 18+ card, firearms licence, birth certificate, Immigration NZ work visa, or passport)

Please note: If your identity document has text on both sides (e.g. driver licence), both sides need to be scanned for it to be accepted.

We will not use or disclose the personal information collected in this form for any other purpose. Once a payment has been made your information will be retained for 6 years in accordance with legal requirements. If you are not eligible for any payment we will delete your information from our records, once all remediation payments have been completed.
